Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of the IMPACCT platform, website and mobile application (collectively, the “Service”), operated by FIRST Infocentre Pvt. Ltd. (Private Limited Company) (“IMPACCT”, “we”, “us”). By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
IMPACCT provides aggregated infrastructure intelligence — tenders, projects, awards, company and professional directory information and related analytics for the Indian market. The Service is a software subscription; it does not procure, bid for, or guarantee the award of any contract on your behalf. Information is provided on an “as is” basis and is compiled from public and third-party sources.
2. Eligibility & accounts
You must be at least 18 years old and capable of forming a binding contract. You are responsible for the accuracy of the registration details you provide, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly of any unauthorised use.
3. Plans, fees & billing
- Paid plans and one-time unlocks are described on our Pricing page. Prices are in Indian Rupees (INR) and are exclusive of applicable taxes unless stated.
- Subscriptions are billed in advance for the stated period (e.g. monthly). One-time unlocks grant access to a specific feature for the stated duration.
- Payments are processed by our payment partner, Razorpay. We do not store your full card or bank credentials. By paying, you also agree to Razorpay’s terms.
- Access to paid features is granted only after your payment is verified.
4. Acceptable use
You agree not to: (a) resell, sublicense, scrape, bulk-download or redistribute data from the Service except as expressly permitted by your plan; (b) use contact information for unlawful, spam or harassment purposes, or in violation of applicable data-protection, telemarketing or anti-spam laws; (c) reverse-engineer, interfere with, or attempt to gain unauthorised access to the Service; or (d) use the Service to build a competing dataset or product.
5. Intellectual property
The Service, its software, design, compilations and branding are owned by FIRST Infocentre Pvt. Ltd. or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes for the duration of your subscription. All rights not expressly granted are reserved.
6. Third-party & public data
The Service aggregates information from government portals, public records and third-party sources. While we take reasonable care, we do not warrant the completeness, accuracy or timeliness of such information, and you should independently verify any data before relying on it for a commercial decision or bid.
7. Disclaimers & limitation of liability
To the maximum extent permitted by law, the Service is provided without warranties of any kind. IMPACCT shall not be liable for any indirect, incidental or consequential loss, loss of profits, business or opportunity, or any reliance on the data. Our total aggregate liability for any claim shall not exceed the fees you paid to us in the three (3) months preceding the event giving rise to the claim.
8. Suspension & termination
We may suspend or terminate your access for breach of these Terms, non-payment, or unlawful use. You may stop using the Service and cancel future renewals at any time as described in the Refund Policy.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, notified to you. Continued use after changes constitutes acceptance.
10. Governing law & jurisdiction
These Terms are governed by the laws of India. Subject to any applicable law, the courts at Mumbai shall have exclusive jurisdiction over any dispute arising out of or in connection with the Service.
